THE CASSELBERRY DIVORCE. The Decree Was Granted on December 15, 1897, But It Has Just Come To Light. After being buried for nearly two months from the public there has at last come to light a bill for divorce which was filed on November 11, 1897, the divorce being granted on the 15th of December of the same year. Even at this late day there would be but little attention paid to it were it not for the prominence of the contracting parties. Jeff D. CASSELBERRY is the petitioner making his wife Mamie A. CASSELBERRY the defendant. Every effort has been made to keep this matter from the public. The case was tried by Judge GALLOWAY in chambers and the decree waa held back for a while in order to throw those who were looking for the proceedings off the scent. It has been known for some time that Mr. and Mrs. CASSELBERRY have been living apart but the real seriousness of the situation was never appreciated until a day or two ago. The petition of Mr. CASSELBERRY is as follows: “Your petitioner J. D. CASSELBERRY respectfully represents to your honor that he and the defendant, Mamie A CASSELBERRY, were married in Hardeman county January 28 1889, and that they have had two children, the fruit of their union, one about 8 years of age and is now with your petitioner the other one about 5 years of age, and is now with the defendant. Your petitioner is now a resident of Shelby county and has been for more than two years. For some years his married life was happy, but for the past few years the defendant's conduct been such as to clearly show that she has lost her affection for him. Their relations became strained more and more as time went on and finally, without fault on his part he was deserted wilfully by the defendant. Premises considered your petitioner prays: “1 That proper process be issued to compel the defendant to appear and answer this petition, but her oath to answer is waived. "2 That an absolute divorce be granted him. “3 That your petitioner have the control and custody of the oldest child which is now with him and the defendant have the control and custody of the youngest child who is now with her, and that both the plaintiff and defendant shall at all times be allowed to see and communicate with their children and have a voice in their care and education. “4 Plaintiff prays for such other further and general relief as he may be entitled to in the premises." Judge GALLOWAY in making the decision followed closely the prayer of the petition, and the decree was drawn on the same lines. He granted absolute divorce. He permitted the husband to retain possession of the elder child and awarded to the mother the younger. He ordered that Mr. CASSELBERRY be responsible for the education of both and gave both father and mother the right to communicate with tha children at any time and to have a voice in their training and education. The father is also required to provide for them during their school days.
