"Benjamin Morse WHITNEY (Micah5, Abel4, Nathaniel3, Benjamin2, John1), son of Micah and Hannah (COBB) WHITNEY, was born 19 Mar 1806, Phillips, ME, and died 1 May 1890, Gardiner, ME, aged 84 years. (Note: Micah WHITNEY brought his family from Gray to Phillips, ME in 1811. G. B. Sedgeley claims to have found a record that Benjamin was born in Gray. He was definitely not born in Phillips.)"

The source outlines the court martial of Benjamin M. WHITNEY that took place on December 24, 1862, based upon records researched in the National Archives. The charge being: "... that he Benjamin M. WHITNEY, Private of Co. G, 17th Maine Vols. did at the time of his enlistment on the 21st day of July 1862, in the name of the United States willfully and fraudulently concealed his true age, and represent himself to be of the age of forty five years of age, when in fact he was fifty-six years of age" and that "... said Benjamin M. WHITNEY, Private, Co. G, 17th Maine Vols. did by fraud and cheating obtain from the Government of the United States, a large sum of money, to wit Twenty-five Dollars as bounty money, and thirteen dollars advance pay, when in fact said Benjamin M. WHITNEY was not entitled to receive or draw the same."
Benjamin WHITNEY stated in his defense: "When the Three hundred thousand troops were called for, there was great enthusiasm in the neighborhood from which I came. I was urged very hard to enlist, they knowing my exact age as well as I did, saying they thought I could get through it. I have hitherto done my duty well, not being on the sick list but once and I think I could get through if I could get rid of carrying my pack. I was at the battle of Fredericksburg and used my musket as well as any one in the Regiment, I think."
The sentence was: "To forfeit all pay, allowances, and bounties now due him, and to be discharged the service, and shall not receive any final statement."

"Benjamin M. WHITNEY, born in Gorham, received his elementary education in the district schools. Subsequently he attended the academy in Limerick, Me., where he was a classmate of one of the Fessendens; and he taught school in this State during the winter until 1868. He then went to Arkansas and from there to Texas. In the latter State he was engaged in teaching for some time. Afterward he went mining in New Mexico. Here, on one occasion, having entered a mine too soon after a blast, he was prostrated by gas, from the effects of which he never recovered. He returned to his home in Maine after a residence of eighteen years in the West, and died from the cause just mentioned. A scholar and an educator of ability, he fully merited the high regard accorded to him by his neighbors and fellow-townsmen. His wife, Susan, a native of Mount Vernon, Me., and a daughter of Nathaniel and Susan (HARRIS) WELLS, of Ipswich, Mass., became the mother of seven children. These were: Phebe C., who is no longer living; Royal T., who now resides in Texas; Martin V., a resident of Lewiston, Me.; Melvina, who is now deceased; Joseph C. Whitney, the subject of this sketch; Mary Clementine, who is the twin sister of Dr. Whitney, and lives in Phillips; and Benjamin D. who resides in Gardiner, Me."
